What these Terms cover
Creatable is a multi-tenant commerce platform for independent shops, product creators, and customers. These Terms apply across the main platform and shops operated through it.
Shop operations
Storefronts, product listings, pricing, customer support, fulfillment, fees, and taxes.
Customers, checkout, and orders
Purchases, payments, returns, refunds, product availability, and shop-specific policies.
Content, designs, and files
Original designs, uploaded files, product artwork, digital downloads, and intellectual property.
1. Introduction
Agreement to these Terms
Welcome to Creatable.shop ("Platform", "we", "us", or "our"), operated by VStudio LLC. These Terms of Service ("Terms") govern your use of our multi-tenant e-commerce platform that enables independent shops ("Shop Tenants") to create and sell custom-designed products, print-on-demand products, self-fulfilled products, and digital downloads. By accessing or using our Platform, you agree to be bound by these Terms.
2. Definitions

These definitions explain how common terms are used throughout this page.
- "Platform": The Creatable.shop website and all associated services.
- "Shop Tenant": Independent businesses or individuals who operate shops on our Platform.
- "Customer": End users who purchase products from Shop Tenants.
- "User": Any person accessing the Platform, including Shop Tenants and Customers.
- "Content": All text, images, designs, files, product data, and other materials uploaded to the Platform.
- "Products": Custom-designed items, print-on-demand products, self-fulfilled products, and digital products created and sold through the Platform.
3. User accounts
Registration
To access certain features, you must create an account. You must:
- Be at least 18 years old or the age of majority in your jurisdiction.
- Provide accurate, current, and complete information.
- Maintain and promptly update your account information.
- Keep your password secure and confidential.
- Accept responsibility for all activities under your account.
3.2 Account termination
Suspension and closure
We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion. You may close your account at any time through your account settings.
4. Shop Tenant terms
Shop operations
Shop Tenants are independent businesses or individuals responsible for their storefronts, products, customer relationships, and business operations.
4.1 Shop operations
Shop Tenants operating on our Platform agree to:
- Operate their shop in compliance with all applicable laws and regulations.
- Provide accurate product descriptions, file descriptions, and pricing.
- Honor all sales and fulfill orders in a timely manner, including self-fulfilled products and digital downloads.
- Handle customer service inquiries professionally.
- Maintain appropriate business licenses and permits.
4.2 Fees and payments
- Shop Tenants may be subject to platform fees, transaction fees, or subscription fees as outlined in their shop agreement.
- We facilitate payment processing but are not responsible for payment disputes between Shop Tenants and Customers.
- Shop Tenants are responsible for their own taxes and financial reporting.
4.3 Shop Tenant relationship
Shop Tenants are independent businesses and not employees, agents, or partners of the Platform. Each Shop Tenant is solely responsible for their products, customer relationships, and business operations.
5. Customer terms
Purchases
- When you make a purchase, you are buying directly from the Shop Tenant, not from the Platform.
- Product availability, pricing, digital access, fulfillment, and shipping are determined by individual Shop Tenants.
- Payment information is processed securely through our payment partners.
5.2 Returns and refunds
Shop-specific policies
Each Shop Tenant sets their own return and refund policies. We encourage Shop Tenants to clearly display these policies, but disputes should be resolved directly with the Shop Tenant.
6. Intellectual property
Content, designs, and files
These terms cover platform content, user content, design ownership, uploaded files, and notices for intellectual-property claims.
6.1 Platform content
All Platform content, including software, design, text, and graphics, is owned by or licensed to us and protected by intellectual property laws.
6.2 User content license
By uploading Content to the Platform, you grant us a non-exclusive, worldwide, royalty-free license to:
- Host, store, and display your Content.
- Process orders containing your Content.
- Create backups and archives.
- Enable Shop Tenants to use your Content for order fulfillment.
6.3 Design ownership
- You retain ownership of original designs you create.
- You represent that you have the right to use all Content you upload.
- You may not upload Content that infringes on others' intellectual property rights.
6.4 DMCA compliance
We respect intellectual property rights and will respond to valid DMCA takedown notices. To report infringement, contact us at legal@creatable.shop with identification of the copyrighted work, identification of the infringing material, your contact information, a statement of good faith belief, and a statement of accuracy under penalty of perjury.
7. Prohibited activities
What you may not do
- Violate any laws or regulations.
- Infringe on intellectual property rights.
- Upload malicious code or interfere with Platform operation.
- Harass, abuse, or harm other users.
- Create fake accounts or engage in fraudulent activities.
- Scrape data or use automated systems without permission.
- Circumvent any security features.
- Use the Platform for any illegal or unauthorized purpose.
Content and products must also comply with our Content Policy.
8. Privacy and data protection
Privacy policy
Your use of the Platform is subject to our Privacy Policy, which explains how we collect, use, and protect your information. Shop Tenants may have additional privacy policies for their shops.
9. Third-party services
Integrated services
The Platform may integrate with third-party services such as payment processors, fulfillment providers, shipping providers, analytics services, and infrastructure providers. Your use of these services is subject to their respective terms and policies.
10. Disclaimers and limitations
Service and liability terms
While we strive for 99.9% uptime, we do not guarantee uninterrupted service. We may perform maintenance, updates, or experience technical issues.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.
We are not responsible for the quality, safety, legality, or any other aspect of products sold by Shop Tenants. Any product issues should be resolved directly with the Shop Tenant.
11. Indemnification
Your responsibility
You agree to indemnify, defend, and hold harmless the Platform and its officers, directors, employees, and agents from claims, damages, losses, or expenses arising from your violation of these Terms, your use of the Platform, your Content, or your violation of any rights of another party.
12. Dispute resolution
Disputes
We encourage you to contact us first to resolve disputes informally. Any disputes not resolved informally shall be resolved through binding arbitration in accordance with American Arbitration Association rules, except where prohibited by law. You agree to resolve disputes on an individual basis and waive class actions, except where prohibited by law.
13-16. Legal terms
Updates and governing law
We may update these Terms at any time and notify you of material changes via email or Platform notification. If any provision is unenforceable, remaining provisions continue in effect. These Terms, our Privacy Policy, and shop-specific agreements form the entire agreement. These Terms are governed by Delaware law.
